IS PROBATE ALWAYS NECESSARY?

No, probate won’t always be necessary. A good rule of thumb is that if the person owned any property, had more than £5,000 in savings, or owned any stocks or shares, you will probably need probate. If the answer to most of those is “no” then you probably won’t need probate. If you need help working out whether or not you need probate, our solicitors can help you to work it out in minutes.

WHAT IF SOMEONE DIES WITHOUT A WILL IN PLACE?

If someone dies without a valid Will in place, they are said to die ‘intestate’ meaning that the rules of intestacy decide what happens to their estate, regardless of what the deceased would have wanted.

You can find our handy intestacy checker here.
