HOW DOES TRANSFERRING EQUITY
WORK IN BRIDGWATER?

THE TRANSFER DEED

The transferrer (person the equity is being transferred from) will instruct a solicitor to prepare a Transfer Deed. This is the document that outlines the wishes of the transferrer including how much equity is to be transferred, and who they are transferring it to.

SIGNING THE DEED

In situations where someone is being removed from ownership of the property, the person being removed from the property’s ownership will need to approve and sign the document.

MORTGAGE REQUIREMENTS (if applicable)

Your solicitor will work with you to make sure that any mortgage requirements or obligations are satisfied. At that point, a completion date can be set.

COMPLETION

On completion, any money that is due to be paid, will be paid over. This is also the point at which any Stamp Duty Land Tax will be paid and filed with HMRC.

LAND REGISTRY

Your solicitor will then file the signed Transfer Deed and send it to the Land Registry to confirm that the equity has been transferred. The Land Registry will then update the property register accordingly.

Stamp Duty Land Tax (SDLT) will not be due on a transfer of equity if:

  • Following a divorce, as part of a court order
  • A divorce results in a transfer of equity
  • A transfer of equity of freehold or leasehold land where no money (consideration) is to be paid from the original owner to the new owner. This would include the gift of a property from a parent to a child.

CAN I TRANSFER EQUITY IN MY PROPERTY FOR CARE HOME FEE PLANNING?

The law around when an estate can be used for care home fees is complex and there is no one answer. If you are looking to remortgage in the interest of planning for care home fees, you will need to speak to our lawyers so that we can understand your individual circumstances and better help you.

CAN I TRANSFER A PORTION OF MY PROPERTY OVER TO MY PARTNER?

If there is a mortgage on the property then you will need to get permission from your lender. Once you transfer the property into another person’s name, that person has rights over the property which will prevent you from selling the property without their consent. If the relationship were to break down, one party may be entitled to claim off the other in order to be taken off the deeds.

HOW LONG DOES IT TAKE TO TRANSFER EQUITY?

The length of time it takes to transfer equity in a property varies from matter to matter. For example, if you there is not a mortgage on the property, the process will be much quicker. On average, it takes between 6 to 10 weeks to transfer equity in a property, but this may differ depending on your circumstances.

DO I HAVE TO USE THE APP?
